He indi - <br /> cated that he thought as a non-conforming use the need to <br /> expand would cause the business to move to an area zoned for <br /> commercial use. He felt it is confusing to think that in <br /> future zoning of presently unzoned townships, all businesses <br /> now in operation would be zoned Existing Commercial . <br /> Boland stated that she felt an error had been made and that <br /> the applicant is being penalized. She continued that she <br /> felt the error should be corrected . <br /> Bob_ Hageman, attorney for Autowerks, noted that if it is <br /> found that an EC-5 zoning for Autowerks is not consistent <br /> with the intent of the Land Use Plan, then he felt all those <br /> properties zoned EC-5 are inconsistent with that intent. <br /> VOTE: 7 in favor (Eddleman, Kramer, Pilkey, Yuhasz, Boland, <br /> Swann ) . <br /> 3 opposed (Margison, Best, Taylor) . <br /> MOTION: Yuhasz moved positive findings on Article 4.2 (criteria) . <br /> Seconded by Kramer . <br /> VOTE: Unanimous. <br /> MOTION: Yuhasz moved to recommend for rezoning to EC-5 as requested. <br /> Seconded by Swann. <br /> VOTE: 8 in favor (Boland, Eddleman, Jacobs, Kramer, Pilkey, Swann, <br /> Taylor, Yuhasz) . <br /> 2 opposed (Margison - would like to see the zoning revert to <br /> R-1 , Best - felt the business should move to a properly <br /> zoned area if expansion is desired) . <br /> (3) Z-5-87 Chandler Concrete Company <br /> Presentation by Greg Szymik. <br /> The property is located in western Cheeks Township on the <br /> south side of US Highway 70 and on the north side of <br /> Southern Railway.
