This <br /> item was presented at public hearing on August 24, 1987 . <br /> BACKGROUND: The property in question is located on the east side of N. C. <br /> Highway 86 north of New Hope Church Road (SR 1723) and south <br /> of Old N. C. 10 . The applicants, Charles Miller and Merle <br /> Dancy, are requesting a rezoning on a portion of lot 1 of <br /> Tax Map 2 - Chapel Hill Township . The property that would be <br /> rezoned contains 41 , 480 square feet or 0 .95 acres . The <br /> current zoning on the property is Rural Residential (R 1 ) . <br /> The proposed zoning is Existing Commercial (EC-5 ) . The <br /> property is the present site of the Autowerks auto repair <br /> garage. <br /> The area is designated as Rural Residential in the Land Use <br /> Plan . The applicants maintain that the existing use was in <br /> operation in 1981 when Hillsborough Township was zoned and <br /> that an error was made at that time. The property was zoned <br /> R-1 and should have been designated Existing Commercial <br /> (EC-5 ) . <br /> The County Attorney has responded to two questions posed at <br /> the public hearing . The first was whether zoning the parcel <br /> to EC-5 would constitute spot zoning . His response is that <br />
