Employees of the District shall not be considered federal <br /> employees for any purpose under this agreement. <br /> I. The District will cooperate, as appropriate, with the Service in <br /> the event of the appeal of any decision of the Service which is <br /> based upon any item of work performed by the District under this <br /> agreement. <br /> J. Any dispute between the District and the Service arising under <br /> this agreement that cannot be resolved at the District <br /> Conservationist level will be referre1 to the Area <br /> Conservationist. Unless reviewed by the State Conservationist, <br /> the Area Conservationist shall be the highest level for dispute <br /> resolution. If the dispute cannot be resolved at the Area <br /> Conservationist level, the State Conservationist, in consultation <br /> with the State Soil Conservation agency, may attempt to effect a <br /> resolution. It is agreed that this is not a contract subject to <br /> the Contract Disputes Act, 41 U.S.C. 601, et. seq. <br /> K. This agreement may be amended by the State Conservationist acting <br /> for the Service and by the Chairman of the District Board acting <br /> for the District. <br /> VI. Definitions <br /> A. All terms herein which are defined in the Food Security Act of <br /> 1985 and implementing regulations & CFR Parts 12, 614, 1940, 1941, <br /> 1943, 1945, and 1980 shall have the same definitions for purposes <br /> of this agreement. <br /> B. The term "Training" means providing opportunities to obtain the <br /> skills and knowledge needed to complete the agreed upon items of <br /> work. <br /> C. The term "Technical Supervision" means providing the day-to-day <br /> guidance needed and/or requested to carry out satisfactorily the <br /> items of work agreed upon in this agreement. <br /> D. The term "Conservation planning" means the gathering of <br /> information and preparation of materials for use in development of <br /> conservation plans, in conformity with the local SCS Service field <br /> office technical guide, for individuals or groups; and arranging <br /> for and conducting group conservation planning meetings. <br />
