During the last two years questions have <br /> been raised with regards to private/public roads and the Planning Staff <br /> don't at this time know what to tell developers. <br /> Motion was made by Commissioner Hartwell, seconded by Commis- <br /> sioner Carey to approve the Preliminary Plan for Sycamore Hill Subdivision <br /> with conditions #1 and #2 as stated above. <br /> Discussion ensued on who should bear the burden of proof. The <br /> County Attorney stated the Ordinance should be followed or it should be <br /> changed to comply with what is being done. <br /> Commissioner Willhoit suggested that a survey be conducted of <br /> those who live on subdivision roads to ascertain a level of satisfaction <br /> or dissatisfaction. <br /> Greg Szymik stated that NCDOT indicated that the cost of main- <br /> taining an unpaved road is approximately half of the cost to maintain a <br /> paved road. <br /> Barry Jacobs assured the Board that the Planning Board will be <br /> studying the issue in an effort to obtain a more concrete interpretation <br /> which will enable them to propose changes in the Ordinance for Board <br /> consideration. <br /> VOTE: AYES, Commissioners Carey, Hartwell and Halkiotis; NOES, Commis- <br /> sioner Willhoit and Chair Marshall. <br /> NOTE: DON WILLHOIT WAS EXCUSED FROM THE MEETING AT 10:10. <br /> 3 . J. D. TERRY PRELIMINARY SUBDIVISION <br /> Greg Szymik presented for consideration of approval <br /> nary Plan for J. D. Terry Subdivision. The property islocatedeinrLittle <br /> River Township on Green Riley Road (SR 1579) . <br /> The applicant proposes to create one (1) aditional lot4by2 dividingathe <br /> tract. One lot would be 2 . 04 acres and the other lot would be 1.99 acres. <br /> The Planning Board and the County Manager recommends approval. <br /> Motion was made by Commissioner Hartwell, seconded by Commis- <br /> sioner Halkiotis to approve the Preliminary Plan for the J. D. Terry Sub- <br /> division. <br /> VOTE: UNANIMOUS. <br /> 4. TURTLEDOVE PRELIMINARY SUBDIVISION <br /> Greg Szymik presented for consideration of approval the Prelimi- <br /> nary Plan for Turtledove Subdivision. The property is located in Chapel <br /> Hill Township on Old Greensboro Highway. it is a 13 .85 acre tract with 5 <br /> lots proposed. The average lot size is 2. 31 acres. The developer is <br /> proposing a private Class B road. The property is zoned Rural Buffer and <br /> designated PW-II in the Land Use Plan. <br /> The Planning Board recommends approval subject to the following <br /> condition: <br /> 1. Include in the Road Maintenance Agreement provisions which <br /> would: <br /> a. Permit the property to the west to have access to the <br /> proposed Turtledove Lane; <br /> b. Require upgrading of the proposed Turtledove Lane to <br /> public road standards if the property to the west is subdi- <br /> vided and accesses Turtledove Lane; and <br /> c. Require upgrading of the proposed Turtledove lane to <br /> public road standards if any parcel within Turtledove Sub- <br /> division and served by the road is further subdivided. <br /> The County Manager recommends approval subject to the condition <br />
