RESOLUTION PETITIONING THE ORANGE COUNTY BOARD OF COMMISSIONERS TO REQUEST <br /> THE NORTH CAROLINA DEPARTMENT OF TRANSPORTATION TO CLOSE S.B. 1100 AND <br /> O A O S.R. 1116 AS NECESSARY TO SERVE THE BEST INTERESTS OF THE PEOPLE OF ORANGE <br /> 4 COUNTY TO PERMIT CONSTRUCTION, OPERATION, AND PROTECTION OF THE CANE CREEK <br /> RESERVOIR <br /> WHEREAS, in order to serve the best interests of the people of Orange County, <br /> and particularly in order to provide for and to assure a safe and adequate public <br /> water supply for present and future Orange County residents who are served by the <br /> public water system operated by the Orange Water and Sewer Authority, the Authority <br /> has acquired approximately 695 acres of the total of approximately 758 acres <br /> necessary for construction of the permanent Cane Creek Reservoir in Bingham <br /> Township, Orange County, North Carolina, and expects to acquire the remaining <br /> approximately 63 acres within the near future; and <br /> WHEREAS, the Authority has constructed a temporary impoundment on a part of the <br /> lands it has acquired on Cane Creek and is presently using the temporary impoundment <br /> as an essential source to supply the existing demand for water in its service area <br /> in Orange County; and <br /> WHEREAS, the Authority has commenced construction activities at the permanent <br /> dam site on lands it has acquired for the Cane Creek Reservoir, and plans to <br /> commence in the near future certain other activities on lands it has acquired for <br /> construction and operation of the permanent Cane Creek Reservoir; and <br /> WHEREAS, the permanent Cane Creek Reservoir will result in the impoundment of <br /> lake waters over and across a portion of S.R. 1100 and over and across a portion of <br /> S.R. 1116; and <br /> WHEREAS, it is essential that those portions of the above roads be abandoned <br /> and closed between the boundaries of the property acquisition lines of the Authority <br /> in order to construct, operate, and protect the Cane Creek Reservoir and thus to <br /> serve the best interests of the citizens of Orange County, North Carolina, by <br /> augmentation and protection of the public water supply available to the citizens of <br /> Orange County. <br /> NOW, THEREFORE, BE IT RESOLVED: <br /> 1. That to permit construction, operation, and protection of the Cane Creek <br /> Reservoir, the Board of Directors of Orange Water and Sewer Authority hereby <br /> petitions that the members of the Orange County Board of Commissioners request, <br /> pursuant to the North Carolina General Statutes 136-63, that the North Carolina <br /> Board of Transportation abandon and close that portion of S.R. 1100 beginning at its <br /> intersection with Cane Creek and running northwest a distance of approximately 1600 <br /> feet, and beginning at its intersection with Cane Creek and running south a distance <br /> of approximately 875 feet, and abandon and close that portion of S.R. 1116 beginning <br /> at its intersection with Cane Creek and running north a distance of approximately <br /> 260 feet, and beginning at its intersection with Cane Creek and running south a <br /> distance of approximately 330 feet, with limits of final abandonment and closing of <br /> both S.R. 1100 and S.R. 1116 to be all portions of each road within and to the <br /> boundaries of the properties owned by Orange Water and Sewer Authority. <br />
