The <br /> Resolution provides for assessment on the basis on an equal <br /> rate per lot. <br /> The Clerk to the Board has filed a Certificate of Mailing <br /> which will certify that the notices of this public hearing <br /> were mailed to each property owner subject to the <br /> assessment. <br /> If the Board finds the Preliminary Assessment Resolution <br /> satisfactory, then the Board can by subsequent action adopt <br /> the Final Assessment Resolution for the project. <br /> Upon adoption of the Final Assessment Resolution, the Pre- <br /> liminary Assessment Roll can be prepared and a public <br /> hearing set to obtain comment on the Roll . <br /> In addition, the Department of Transportation can be <br /> forwarded the local share of the construction costs of the <br /> project. <br /> At the August 18, 1987 meeting of the Board of <br /> Commissioners, a question arose concerning the validity of <br /> the petition . Specifically, three property owners had signed <br /> the petition conditioned upon the assessment being set on an <br /> equal share per property owner basis. The County Attorney <br /> indicated that such an assessment method was not possible, <br /> and the 75% participation requirements may not be met. <br /> The Planning Staff subsequently contacted the three affected <br /> property owners. All wish to go ahead with the project with <br /> an assessment on an equal rate per lot. All of them that <br /> signed the original petition are ratifying their signatures <br /> on the petition without conditions. <br /> RECOMMENDATION : The Manager recommends adoption of the Final Assessment <br /> Resolution for Moriah Hill Road and Timberly Drive: <br /> Accept the Certificate of Mailing offered by the Clerk to <br /> the Board and attached to this agenda item. <br /> Schedule the public hearing on the Preliminary Assessment <br /> Roll for October 20, 1987. <br />
