119 Turtledove Lane ( 1160 feet) would be needed to meet NCDOT <br /> standards. Although five (5 ) lots are proposed, one lot is <br /> occupied by an existing house with access to S.R. 1005 . <br /> Thus, the street may not be accepted for maintenance by <br /> NCDOT. <br /> Although the developer has indicated that access to <br /> Turtledove Lane would be restricted to lots located 'thereon, <br /> a 112 acre tract is located to the west of the proposed <br /> private road. A condition should be included which permits <br /> access to Turtledove Lane in the event the adjoining <br /> property is developed. Such a condition would prevent double <br /> frontage lots from occurring. <br /> At its August 17, 1987 meeting, the Orange County Planning <br /> Board recommended approval of the preliminary plan for <br /> Turtledove Subdivision subject to the following condition : <br /> 1 . Include in the Road Maintenance Agreement provisions <br /> which would : <br /> a. Permit the property to the west to have access to <br /> the proposed Turtledove Lane; <br /> b . Require upgrading of the proposed Turtledove Lane <br /> to public road standards if the property to the <br /> west is subdivided and accesses Turtledove Lane; <br /> and <br /> c. Require upgrading of the proposed Turtledove Lane <br /> to public road standards if any parcel within <br /> Turtledove Subdivision and served by the road is <br /> further subdivided. <br /> The Planning Board decision to permit a private road was <br /> based on the fact that the proposed Turtledove Subdivision <br /> was located in University Lake watershed. A private, unpaved <br /> road (Class B ) would reduce the amount of impervious surface <br /> in the development and in the watershed. <br /> RECOMMENDATION: The Manager recommends approval of the subdivision per the <br /> Planning Board 's recommendation but with one additional <br /> condition : <br /> d. In the event that Turtledove Lane is upgraded by <br /> development of the property to the west, the owners of <br /> property in Turtledove Subdivision as well as the <br /> owners of the property being developed to the west will <br /> agree to maintain Turtledove Lane in an upgraded <br /> condition (NCDOT standards) until NCDOT accepts the <br /> road for maintenance . <br />
