7 <br /> 0 PRIVATE ROAD JUSTIFICATION: RAM's WOODS SUBDIVISION <br /> The following justification for a private road in RAM'S Woods follows <br /> the five points on pages 30, 30a and 31 of the April 4, 1988 revisions to <br /> the Subdivision Regulations for Orange County, North Carolina. The five <br /> points discuss design features to be considered in decisions to allow <br /> private roads. <br /> General Statement <br /> The proposed private road will serve five lots averaging 2.6 acres <br /> each. The road will be approximately 677 feet long ending in a cul de <br /> sac. It will be built to class A standards. Restrictive subdivision <br /> covenants will preclude further subdivision. A perpetual maintenance <br /> agreement will assign maintenance responsibilities to subdivision lot <br /> owners. <br /> The owners of the proposed subdivision have lived on adjacent land for <br /> nine years and thus have an interest in developing and maintaining the new <br /> subdivision and its road in a manner that will enhance its quality and <br /> character. <br /> 1. Road Preserves Rural Character <br /> RAM'S Woods lies on 15 acres of heavily wooded mature hardwood <br /> forest in an area of low housing density. <br /> a. The average lot size is 2.6 acres. All of the five lots are <br /> larger than required by ordinance. Setback lines are 45 feet, also greater <br /> than required by ordinance provision. <br /> b. The wooded character of the subdivision will be preserved, thus <br /> screening the subdivision from the view of public roads. The only public <br /> road from which any part of the subdivision is visible ends at the <br /> beginning of the subdivision, also underlining its rural character. <br /> c. The wooded scenic appearance of the subdivision will be <br /> maintained by removal of only those trees required for road and driveway <br /> access. Because lot sizes are large, most of the subdivision will remain <br /> wooded. <br /> d. Maximum wildlife and botanical species will be maintained by <br /> minimal destruction of the mature hardwood forest. <br /> 2. State Maintenance <br /> The road will be built to state standards, and presumably the state <br /> would accept the road for maintenance. However, the proposed road will <br /> serve only five lots in a low density, secluded area. For this reason and <br /> because the road is only 677 feet long, it is unlikely that state <br /> maintenance would ever be requested. <br />• 3.- Restrictive Covenants <br /> Subdivision covenants will expressly forbib further subdivision. This <br /> will maintain the low density character of the subdivision. . <br />
