78 <br /> and Hazardous Waste Management Act <br /> - is within a water supply watershed <br /> -- contains areas identified in the Orange County <br /> Inventory of Natural Areas <br /> - contains site identified in "An Inventory of Sites <br /> of Cultural, Historical, Recreational, Biological, <br /> and Geological Significance in the Unincorporated <br /> portions of Orange County" <br /> - existing or proposed lots have average slope of <br /> more than 15% <br /> - the area of development exceeds 100 acres <br /> - a perennial stream is to be crossed by a road, <br /> bridge, or driveway <br /> - a proposed structure exceeds 25,000 square feet <br /> - total land disturbance (excluding roads) exceeds <br /> 40, 000 square, feet <br /> -- commercial or industrial water usage will exceed <br /> (Figure to be determined) <br /> - other potentially significant environmental impacts <br /> have been identified by the Planning Staff <br /> Bona fide farms, development on parcels less than 2 acres, <br /> and facilities related to the distribution of public <br /> utilities are exempt from the requirements of the ordinance. <br /> These criteria are the result of meetings and discussion <br /> between Planning Staff and the Ordinance Review Committee. <br /> The intent has been to identify areas of concern specific to <br /> Orange County. As additional information and comments are <br /> received through the public hearing process the criteria can <br /> be refined. Defining when and where the ordinance is to be <br /> applied is a cornerstone to its effectiveness and should be <br /> thoroughly reviewed and evaluated. <br /> ENVIRONMENTAL ASSESSMENT <br /> An Environmental Assessment would be required if any of <br /> the above criteria applied, and would entail completion of <br /> supplement to the application for Subdivision, Planned <br /> Development, Special Use Permit or Site plan approval. Upon <br /> review of the application, Planning Staff will notify the <br /> developer immediately if an EA is required but was not <br /> submitted with the development application.
