19
connected to a 50-foot easement leading to the
subdivision. A Class C private road (Home Road)
is in existence. A partial width right-of-way
is needed since the adjoining tract is heir
property and all heirs will not grant an
additional five (5) feet of right-of-way.
A previous partial width right-of-way was
requested for this road by Elizabeth Crais and
Michael Wagner. The Planning Board and Board of
Commissioners granted approval on February 15,
1988 and March 2, 1988, respectively. This
proposal was for two Class C private roads
(Crais Lane and Home Road) . The Zaragozas have
revised the right-of-way in order to create one
private road instead of two private roads.
The Administration recommends approval.
There was question as to why a partial width
right-of-way as needed if one had been
previously approved. Scearbo responded that the
site was being subdivided and an additional lots
was being created. Also, the road right-of-way
was modified to round out an intersection and
• create one continuous private road instead of
two.
MOTION: Best moved approval. Seconded by Pilkey.
VOTE: Unanimous.
.ti
r -
