9. Personal Injury or Property Damage 023 <br /> The State shall defend, indemnify and hold harmless the <br /> County against any claim, cost, expense, liability, action or <br /> judgement arising out of or related to any personal injury, <br /> death or property damage with respect to the Leased Premises <br /> to the extent allowed by law. <br /> 10. Insurance <br /> The County shall ensure that all risks of physical loss or <br /> damage insurance coverage is provided to the leased premises. <br /> Contents of the leased premises will be insured by the State <br /> of North Carolina. <br /> If the said premises be destroyed by fire or other casualty, <br /> without fault of the State, this lease shall immediately <br /> terminate and the rent shall be apportioned to the time of <br /> the damage. In case of partial destruction or damage by fire <br /> or other casualty without fault of the State, so as to render <br /> the premises untenantable in whole or in part, there shall be <br /> an apportionment of the rent until the damage has been <br /> repaired. During such period of repair, the State shall have <br /> the right to obtain similar office space at the expense of <br /> the State or the State may terminate the lease by giving <br /> fifteen (15) days written notice to the County. <br /> The State shall provide at its expense liability insurance, <br /> naming the County as an additional insured, covering its <br /> activities as the Department of Housing and Community <br /> Development Administration Building in limits as follows: <br /> a. Worker's Compensation If user falls under the State <br /> of N. C. workers ' compensation law, coverage shall be <br /> provided for all employees. The coverage shall be <br /> statutory limits in compliance with the applicable state <br /> and federal laws. <br /> b. Comprehensive General Liability : Coverage shall be per <br /> occurrence combined single limit for bodily injury and <br /> property damage liability including premises and <br /> operations, coverage limit to be $1, 000,000. <br /> Certificates of insurance or verification of self-insurance <br /> shall be provided to the County's Purchasing Director. Said <br /> insurance shall provide that the County shall be given at <br /> least 30 days prior written notice before the policy may <br /> altered, amended, cancelled or terminated or allowed to <br /> lapse. <br /> The State shall maintain insurance coverage with respect to <br /> its property located in or on the leased premises. The <br /> County will ensure that the building property damage coverage <br /> is maintained, but will in no way assume responsibility for <br /> State property on the premises. <br />
