Partial Width Right-of-Way <br /> ( 1 ) Frances S . Howard <br /> Presentation by Marvin Collins . <br /> Mrs . Frances Howard and husband, William, <br /> currently reside on the property and wish to pro- <br /> vide two lots for their sons, Charles Howard and <br /> Nathaniel Howard. The Planning Board granted <br /> Mrs . Howard a 25 foot partial width right-of-way <br /> on December 17 , 1984 . A 40 foot private road <br /> (Jack Gates Road) approximately 1100 feet in <br /> length would be connected to the 25 foot easement <br /> (granted by Mrs . Juanita McCauley, Lot 21A) <br /> leading to the subdivision. However, when the <br /> Easement Agreement was prepared Mrs . McCauley <br /> refused to sign. She was willing to provide a <br /> verbal agreement only. <br /> Mrs . Howard has since arranged an easement with <br /> another property owner, Mr. Raymond Atwater. To <br /> provide access, a 30 foot easement 413 .45 feet in <br /> length would be connected to a 50 foot easement <br /> leading to the subdivision. A Class C private <br /> road (Howard Hill Road) is proposed. A partial <br /> width right-of-way is needed due to the topography <br /> of the land and the lot configuration. <br /> Collins reviewed the copy of the plat in the <br /> agenda packet (attached as part of these minutes ) <br /> explaining the easement agreement with Mr. <br /> Atwater. <br /> The Planning Staff recommends approval. <br /> MOTION: Best moved approval . Seconded by Eddleman. <br /> VOTE; 7 in favor. <br /> 1 abstained (Yuhasz - due to professional conflict <br /> of interest) . <br />
