106 <br /> 1 . Larger lots than required; <br /> 2 . Larger building setbacks than required; <br /> 3 . More landscaping than is required; <br /> 4 . The maximum stream buffer; <br /> 5 . Restrictive covenants to prevent further <br /> subdivision of the ten lots proposed, to <br /> preserve landscaping, and to provide appearance <br /> guidelines; and <br /> 6 . A 50-foot strip of common open space <br /> surrounding the subdivision for equestrian <br /> trails . <br /> The Planning Staff recommends approval of the <br /> preliminary plan for Setter Run Section Two with a <br /> Class A private road subject to the following <br /> conditions : <br /> 1 . Restrict the use of Setter Lane to only the ten <br /> lots in Section Two; <br /> 2 . Submit Restrictive Covenants and Road <br /> Maintenance Agreement for review and approval <br /> - by the County Attorney; and <br /> 3 . Provide a note on the final plat regarding <br /> restricted use of the required Stream Buffer. <br /> Best asked how condition #1 would apply in the <br /> case of further subdivision. Collins responded <br /> that adjoining tracts had other available access . <br /> He continued that this condition would combine <br /> with restrictive covenants to insure no further <br /> subdivision within this development. The reason <br /> Staff recommended a Class A private road was that <br /> this subdivision is being developed to the point <br /> where a Class A road is normally required. <br /> Best asked that a condition #4 be added as <br /> follows : <br /> Restrictive covenants to prevent further <br /> subdivision of the ten lots proposed, to preserve <br /> landscaping, and to provide appearance guidelines . <br /> MOTION: Best moved approval with the four conditions . <br /> Seconded by Pilkey. <br />
