I have <br /> reviewed the so-called application that accompanied <br /> Gary ' s November 25 letter and the copy of Gaston <br /> County ' s similar document with Marvin 's August 20 <br /> letter. Enclosed is a document that I have captioned <br /> "Affidavit in Support of Exemption from General <br /> Contractor Licensing Requirements . " It is similar in <br /> substance to the documents provided by both of you. In <br /> that regard , the recitation of the general contractor <br /> definition contained in the North Carolina General <br /> Statutes is verbatim in the affidavit attached . It was <br /> apparently paraphrased in the applications you provided <br /> me . Also, I have changed the word " will" to may in <br /> that portion of the affidavit talking about violations <br /> of law and revocation of permits . I think this <br /> necessary because there may be some cases where a <br /> homeowner could function as a general contractor and <br /> then sell his home before the certificate of occupancy <br /> is issued . In any event , we certainly can make a <br /> determination about whether there is a violation of the <br /> general contracting law and can revoke the permit where <br /> the facts indicate we should . <br /> Finally, i have changed the document from an <br /> application to an affidavit because the application <br /> form suggests some kind of licensing resulting from the <br /> application. Since Orange County will not be licensing <br /> unlicensed contractors , I think the affidavit format <br />
