Board of Commissioners approve a similar <br /> 090 resolution. At its February 1, 1988 <br /> meeting. the Board of Commissioners <br /> approved such a resolution and set <br /> February 22 as the public hearing date <br /> to consider incorporating the policy <br /> into the Subdivision Regulatiions. <br /> EXISTING ORDINANCE PROVISIONS: Section IV-B-3-d <br /> Private roads may be allowed in a subdivision where: <br /> 1 . In the judgment of the Planning Board and with the <br /> approval of the Commissioners, it is found that the <br /> nature and location of the subdivision, including such <br /> considerations as topography, the surrounding area. the <br /> present and future road plans, and access by public <br /> safety vehicles are such that a private road is <br /> justified; and <br /> 2. If one or more of the following conditions are met: <br /> a. The subdivision consists of less than ten (10) <br /> lots. <br /> b. The subdivision preserves a natural area through <br /> deed restrictions and special design features. <br /> c. The subdivision does not embrace or abut any part <br /> of a thoroughfare or street shown on the Orange <br /> County Thoroughfare Plan, or a municipality' s <br /> thoroughfare plan within the county, or does not <br /> lie within a designated Transition Area as <br /> determined by the County. <br /> d. The subdivision joins or extends an existing <br /> subdivision where the streets of the subdivision <br /> are private or unpaved. and the new subdivision <br /> shall be platted to connect with the streets of <br /> such existing subdivision and be compatible with <br /> and in harmony with the surrounding community. <br /> e. The subdivision roads, even if constructed to State <br /> standards, would not be accepted by the State for <br /> maintenance due to density or some other State <br /> requirement that the subdivision cannot meet <br /> For a subdivision to be approved with private roads. it <br /> should meet as many of the above criteria as possible; <br /> provided, however , the meeting of one or more of the <br /> specified conditions will not insure automatic approval of <br /> private roads. <br /> PROPOSED ORDINANCE PROVISIONS: <br /> IV-B-3-d Roads <br /> Public roads are generally reuired in all subdivisions and <br /> will be rquired where it is found that: <br />
