7 <br /> junked automobiles on property on the east side of Old NC 86, north of <br /> Eubanks Road. This property is zoned Rural Buffer (RS) . The owner and the <br /> tenant have both been contacted about the Zoning Ordinance violation but <br /> have not responded. The Administration recommends initiation of legal <br /> proceedings against both George Tate and Ray Butler. <br /> Motion was made by Commissioner Hartwell, seconded by Commissioner <br /> Carey to approve the administration's recommendation. <br /> VOTE: UNANIMOUS. <br /> 9. Request to Initiate Legal Action - Benjamin Pratt <br /> Marvin Collins explained that junked automobiles are being stored <br /> on private property and that the situation has extended over a two year <br /> period. Mr. Pratt is in violation of the Zoning Ordinance Section 6. 16.7. <br /> The Administration recommends initiation of legal proceedings against <br /> Benjamin Pratt. <br /> Motion was made by Commissioner Hartwell, seconded by Commissioner <br /> Carey to approve the administration's recommendation. <br /> VOTE: UNANIMOUS. <br /> 10. Rate Schedule for Efland/Cheeks Sanitary Sewer <br /> (A copy of this rate schedule nd , the Executive Summary is <br /> attached to these minutes on pages q�P G-: h�2 changes in the sewer rate <br /> County Manager John Link summarized g <br /> and tap fee which have occurred since the initial sign-up period for the <br /> Efland/Cheeks Sanitary Sewer Service Area. He recommended that the <br /> original estimated rate schedule be used for the first fiscal year of <br /> operation and that it be adjusted for 1989-90 based on up-coming FY 88-89 <br /> history of expenditures review. During the 1988-89 year he recommended <br /> that (1) present and potential customers be informed that future rate <br /> structure is dependent on present/potential number of customers and/or <br /> degree of usage, and (2) an incentive program be initiated to encourage <br /> tap-ons. <br /> Motion was made by Commissioner Hartwell, seconded by Commissioner <br /> Carey to approve the County Manager's recommendation. <br /> VOTE: UNANIMOUS. <br /> 11. Smoking Policy for County Buildings <br /> (A copy of the Smoking Policy is in the policy book # • ) <br /> The County Manager recommended that the proposed policy for <br /> designating smoking and non-smoking areas be approved with the following <br /> conditions: <br /> (1) Effective Date: September 1, 1988. <br /> (2) Test period of implementation of one year. <br /> (3) Evaluation of test period to be conducted by joint <br /> Management/Employee Committee. <br /> (4) Report back to County Manager with recommendation as to any <br /> changes in policy. <br /> (5) Manager evaluate the costs as cited in the report <br /> incorporating necessary cost of implementation in 1988-89 budget. <br /> Motion was made by Commissioner Halkiotis, seconded by <br /> Commissioner Carey to approve the County Manager's recommendation. <br /> VOTE: UNANIMOUS. <br /> 12. Master Recreation and Parks Plan Scheduling of Public Hearing <br /> April 19, 1988 <br /> In response to a request from several citizens to have a second <br /> public hearing on the Plan, the Board of Commissioners agreed to add a <br /> second public hearing on May 2 in Superior Courtroom. <br /> Motion was made by Commissioner Carey, seconded by Commissioner <br />
