061. 2
The subdivision is the fifth occuring along Cheyenne Drive
in the past two years. The NC Department of Transportation
has indicated that Cheyenne Drive could be accepted for
maintenance if upgraded to the State specifications for
unpaved roads.
Orange Water and Sewer Authority provided standard comments
regarding individual septic tanks and sedimentation and
erosion control as follows:
1. A dual absorption field system should be required to be
installed at the time each lot is developed (alternat-
ing use between the two fields on a regular basis) ,
with an additional back-up field area also being
required. Supporting information on this approach is
enclosed for your consideration. OWASA staff recog-
nizes that this will result in increased construction
costs and greater initial clearing for the system
installation; however. the long-term benefits to water
quality. public health and future owners of the
property should offset these costs.
2. The primary and back septic tank system sites identi-
fied and approved by the Orange County Health Depart-
ment should be clearly designated on the plats and
deed/survey for each lot. These sites must be required
to remain undisturbed and reserved by present and
future owners for such use. OWASA has been informed of
one reported case where a reserve site identified by
the Health Department was rendered unusable due to
construction of improvements after the initial resi-
dence had been completed.
OWASA also requested that easements be reserved for the
extension of public sewer lines, if that is determined to be
necessary and desirable in the future.
The County is restricted to the requirements of the Health
Department and the N.C. Division of Environmental Management
insofar as septic tank fields are concerned. There are no
provisions in either the Zoning Ordinance or the Subdivision
Regulations which would permit the inclusion of OWASA' s
recommendation for dual absorption fields as a condition of
approval. County policy regarding the extension of public
water and sewer into the Rural Buffer and Protected
Watershed areas also prevents reservation and/or dedication
of utility easements for that purpose.
The Planning Board recommended approval of the preliminary
plan for the subdivision of the James Mark Vine property
with the following conditions:
(1) Upgrade Cheyenne Drive to meet NCDOT construction
specifications for unpaved roads and petition the State
for acceptance of Cheyenne Drive into its maintenance
system.
(2) Indicate the location of primary and backup septic tank
