Q � <br /> 5 <br /> requirements for stormwater management. Yuhasz <br /> noted that it is not referenced in the letter from <br /> Erosion Control Officer Warren Faircloth. Pilkey <br /> indicated a preference to defer action until more <br /> comment from Warren. Yuhasz noted that he felt a <br /> condition could be added to address the possibility <br /> of required maintenance without delay the project. <br /> Jacobs reminded the Board that the County Attorney <br /> had expressed concern with the Planning Board <br /> making speculative conditions. Collins indicated <br /> that it is a permanent structure to be either <br /> maintained by the lotowner or a Homeowners ' <br /> Association . <br /> The developer indicated he does prefer to combine <br /> lots 6 & 7 and lots 11 & 12 in order to have <br /> suitable septic fields on all lots. <br /> Jacobs noted that condition #1 should now read : <br /> Combine lots 6 & 7 and 11 & 12 for Health <br /> Department approval . <br /> Add condition 18: <br /> Stormwater detention area of combined lots 11 & 12 <br /> be designated as unsuitable for development <br /> purposes and to be maintained by the owner of that <br /> lot and indicated on the plat. <br /> MOTION: Yuhasz moved approval with conditions #1 -6 and #8, <br /> deleting #7 . Seconded by Dickinson . <br /> Pilkey asked why the opposition to condition #7 . <br /> Yuhasz responded that it is difficult to locate and <br /> designate specific sites on a plat. He felt it was <br /> enough that the Health Department indicated there <br /> is sufficient area for a primary and backup septic <br /> field. <br /> Eddleman asked how specific sites would be located . <br /> Collins responded that indicating the general <br /> vicinity on the plat would be sufficient. Best <br /> asked if Chapel Hill and Carrboro require this <br /> designation on plats. Collins responded that <br /> Carrboro has such a requirement but he was not sure <br /> about Chapel Hill . Collins noted that another <br /> reason for such a requirement would provide <br /> assurance that backup systems would not intrude <br /> into buffers or setbacks. Collins suggested that <br /> the condition be cancelled and that Staff would <br /> seek answers to all the questions presented from <br /> the Health Department. <br /> VOTE: 6 in favor. <br /> 2 opposed (Pilkey and Bilbro - felt condition 17 <br /> should be retained ) . <br />
