Q
5
requirements for stormwater management. Yuhasz
noted that it is not referenced in the letter from
Erosion Control Officer Warren Faircloth. Pilkey
indicated a preference to defer action until more
comment from Warren. Yuhasz noted that he felt a
condition could be added to address the possibility
of required maintenance without delay the project.
Jacobs reminded the Board that the County Attorney
had expressed concern with the Planning Board
making speculative conditions. Collins indicated
that it is a permanent structure to be either
maintained by the lotowner or a Homeowners '
Association .
The developer indicated he does prefer to combine
lots 6 & 7 and lots 11 & 12 in order to have
suitable septic fields on all lots.
Jacobs noted that condition #1 should now read :
Combine lots 6 & 7 and 11 & 12 for Health
Department approval .
Add condition 18:
Stormwater detention area of combined lots 11 & 12
be designated as unsuitable for development
purposes and to be maintained by the owner of that
lot and indicated on the plat.
MOTION: Yuhasz moved approval with conditions #1 -6 and #8,
deleting #7 . Seconded by Dickinson .
Pilkey asked why the opposition to condition #7 .
Yuhasz responded that it is difficult to locate and
designate specific sites on a plat. He felt it was
enough that the Health Department indicated there
is sufficient area for a primary and backup septic
field.
Eddleman asked how specific sites would be located .
Collins responded that indicating the general
vicinity on the plat would be sufficient. Best
asked if Chapel Hill and Carrboro require this
designation on plats. Collins responded that
Carrboro has such a requirement but he was not sure
about Chapel Hill . Collins noted that another
reason for such a requirement would provide
assurance that backup systems would not intrude
into buffers or setbacks. Collins suggested that
the condition be cancelled and that Staff would
seek answers to all the questions presented from
the Health Department.
VOTE: 6 in favor.
2 opposed (Pilkey and Bilbro - felt condition 17
should be retained ) .
