Kirk <br /> responded that it is an intermittent stream with a <br /> 50-foot stream buffer along the back of lots 9 <br /> through 12 with a stormwater detention area on lot <br /> 12 . Best asked if the detention area is permanent. <br /> Kirk responded that he understood that area is to <br /> remain undisturbed. Jacobs asked if that could be <br /> indicated . Kirk responded that it could be added <br /> as a condition of approval . Yuhasz noted that an <br /> easement for maintenance if needed could be indi- <br /> cated. Crudup noted that water would not be in the <br /> detention area at all times; it will be permanent <br /> so that runoff is not increased from the current <br /> rate. She continued that there would not be water <br /> there except during or immediately after a heavy <br /> rain . Jacobs asked who would provide maintenance <br /> if it is required.
