ORANGE COUNTY
BOARD OF COMMISSIONERS ACTION AGENDA
ACTION AGENDA ITEM ABSTRACT ITEM NO.
MEETING DATE March 1, 1988
SUBJECT: Lake Orange Road
DEPARTMENT: Planning/County Manager/
County Attorney
PUBLIG HEARIWG: YES x NO
ATTACHMENT(S) : Copy of Preliminary INFORMATION CONTACT:
Plan Eno River Estates
Copy of Recorded Plat Just-A-Mere- PHONE NUMBERS: HILLSBOROUGH - 732-8181
Landing HILLSBOROUGH - 732-9361
Copy of Plat Lake Orange Road Extension CHAPEL HILL w 967-9251
MEBANE - 227-2031
DURHAM -- 688-7331
PURPOSE: To consider transferring title to property owned by Orange County of the land
necessary for the right-of-way for Lake Orange Road from the point where State
maintenance of Lake Orange Road. currently ends north to the point where it
exits the Eno River Estates Subdivision.
BACKGROUND: The County Attorney has been contacted by the attorney representing George
and Marcia Lattimore requesting assistance. in acquiring an easement from
Orange County to the Lattimores for that portion of Lake Orange Road
traversing the property owned by Orange County which property contains
the Lake Orange dam and spillway area. Previously, the Board of County
Commissioners approved Eno River Estates Subdivision upon the condition
that Lake Orange Road be publicly dedicated and improved to North Carolina
Department of Transportation standards. Another condition of approval of
Eno River Estates is that the bridge across the Eno River downstream
from the spillway be improved to North Carolina Department of Transporta-
tion standards. Also, the property to the south of Eno River Estates
is owned by the Tolars and its status as a public right-of-way is not
clear. After reviewing all of this it is the conclusion of the County
staff that the best solution to the right-of-way questions surrounding
Lake Orange Road is for all parties involved and with an ownership
interest in the road to deed the property to the State of North Carolina
and particularly the North Carolina Department of Transportation for
public right-of-way purposes. The Tolars and the Lattimores have agreed
to convey their interests in the property to the State for public right-
of-way purposes and the State will apparently accept such a conveyance.
In that regard, the County Attorney spoke with J. M. Mills with the
Department of Transportation's district office, concerning this plan.
Mr. Mills indicates that the State has in the past accepted conveyances
of the nature described here and more than likely will be willing to
accept this conveyance.
