ORANGE COUNTY <br /> BOARD OF COMMISSIONERS ACTION AGENDA <br /> ACTION AGENDA ITEM ABSTRACT ITEM NO. <br /> MEETING DATE March 1, 1988 <br /> SUBJECT: Lake Orange Road <br /> DEPARTMENT: Planning/County Manager/ <br /> County Attorney <br /> PUBLIG HEARIWG: YES x NO <br /> ATTACHMENT(S) : Copy of Preliminary INFORMATION CONTACT: <br /> Plan Eno River Estates <br /> Copy of Recorded Plat Just-A-Mere- PHONE NUMBERS: HILLSBOROUGH - 732-8181 <br /> Landing HILLSBOROUGH - 732-9361 <br /> Copy of Plat Lake Orange Road Extension CHAPEL HILL w 967-9251 <br /> MEBANE - 227-2031 <br /> DURHAM -- 688-7331 <br /> PURPOSE: To consider transferring title to property owned by Orange County of the land <br /> necessary for the right-of-way for Lake Orange Road from the point where State <br /> maintenance of Lake Orange Road. currently ends north to the point where it <br /> exits the Eno River Estates Subdivision. <br /> BACKGROUND: The County Attorney has been contacted by the attorney representing George <br /> and Marcia Lattimore requesting assistance. in acquiring an easement from <br /> Orange County to the Lattimores for that portion of Lake Orange Road <br /> traversing the property owned by Orange County which property contains <br /> the Lake Orange dam and spillway area. Previously, the Board of County <br /> Commissioners approved Eno River Estates Subdivision upon the condition <br /> that Lake Orange Road be publicly dedicated and improved to North Carolina <br /> Department of Transportation standards. Another condition of approval of <br /> Eno River Estates is that the bridge across the Eno River downstream <br /> from the spillway be improved to North Carolina Department of Transporta- <br /> tion standards. Also, the property to the south of Eno River Estates <br /> is owned by the Tolars and its status as a public right-of-way is not <br /> clear. After reviewing all of this it is the conclusion of the County <br /> staff that the best solution to the right-of-way questions surrounding <br /> Lake Orange Road is for all parties involved and with an ownership <br /> interest in the road to deed the property to the State of North Carolina <br /> and particularly the North Carolina Department of Transportation for <br /> public right-of-way purposes. The Tolars and the Lattimores have agreed <br /> to convey their interests in the property to the State for public right- <br /> of-way purposes and the State will apparently accept such a conveyance. <br /> In that regard, the County Attorney spoke with J. M. Mills with the <br /> Department of Transportation's district office, concerning this plan. <br /> Mr. Mills indicates that the State has in the past accepted conveyances <br /> of the nature described here and more than likely will be willing to <br /> accept this conveyance. <br />
