To consider approval of a right-of-way certificate to the Farmers Home <br /> Administration for the right-of-ways needed for the construction, opera- <br /> ' tion and maintenance of the Efland Area Sewer System. <br /> BACKGROUND: On June 16, 1987 the Board of County Commissioners approved a pre- <br /> liminary right-of-way certificate and authorized the Chair of the <br /> ' Board to sign the right-of-way certificate which certificate covers <br /> the rights-of-way needed for the construction, operation and mainte- <br /> nance of the Efland Area Sewer System. The $200,000s of bonds for <br /> the project have been purchased by Farmers Home Administration. <br /> The closing on the bond sale will occur mid March, 1988. The . <br /> County is being asked to provide the closing documents, including <br /> the right-of-way certificate and the opinion of counsel relative <br /> to rights-of-way on or about March 1, 1988. <br /> The final right-of-way certificate, a copy of which is attached <br /> • to this agenda abstract, reflects that the exceptions to con- <br /> tinuous and adequate rights-of-way on private lands existing <br /> on June 16,1987 have been resolved. The only exception listed <br /> is that related to reservations or restrictions contained in <br /> any North Carolina Department of Transportation, Town of <br /> Hillsborough or Southern Railway encroachment agreement. <br /> RECOMMENDATION(S) : Authorize the Chair to sign the right-of-way certificate. <br /> Direct -the County Attorney to transmit the right-of-way <br /> certificate along with his opinion of counsel relative <br /> to rights-of-way for the purpose of closing the bond sale. <br />
