AGENDA ITEM #9: PLANNING BOARD ITEMS .. <br /> a. Elizabeth Crais/Michael Wagner <br /> 114 <br /> (Request for Partial Width R/W) <br /> Presentation by Marvin Collins . <br /> Ms . Elizabeth Crais and Mr . Michael Wagner wish to <br /> purchase an existing house and surrounding <br /> property, and propose a one- lot subdivision for <br /> this purpose. To provide access, an existing 45- <br /> foot easement approximately 1960 feet in length <br /> would be connected to a 50-foot easement leading to <br /> the subdivision . Two Class C private roads (Crass <br /> Lane and Home Road ) are proposed . A partial width <br /> right-of-way is needed for Home Road, since the <br /> adjoining tract is heir property and all heirs will <br /> not grant an additional five (5 ) feet of right-of- <br /> way. <br /> While there is an existing 50-foot easement <br /> extending southward from New Sharon Church Road via <br /> Buck Quarter Farms, the topography of the land is <br /> hilly with deep ravines and gullies. It would thus <br /> not be economically feasible to construct a road in <br /> the easement. <br /> Jacobs asked what steps were taken to try and <br /> acquire the additional right-of-way that is needed . <br /> Ms . Crass responded that after discussion with the <br /> owner, her attorney began contacting the heirs. <br /> Considerable opposition was met and he attorney <br /> recommended she contact the Planning Department <br /> about a possible alternative. <br /> Collins presented photographs showing the existing <br /> road and easement and stated the existing road is a <br /> very satisfactory Class C private road . <br /> MOTION: Best moved approval . Seconded by Pilkey . <br /> VOTE: Unanimous . <br />
