1.11 <br /> January 25, 1988 <br /> To whom it may concern, <br /> We are requesting that approval be granted for the future use of <br /> the existing driveway leading to the property of Dr . William and Mary <br /> Lynn. We wish to purchase a house and a piece of the Lynn ' s prcoperty <br /> and have already obtained an easement and road maintenance agreement <br /> from the Lynns pertaining to the driveway. The driveway currently has <br /> a 45 foot easement and to obtain a larger easement would apparently be <br /> quite a difficult process. As noted by the Lynn ' s attorney, Dalton <br /> Loftin„ the process would be costly and time consuming and still may <br /> not result in the granting of additional footage to the easement . <br /> The current driveway leads to three homes located on the Lynn ' s <br /> property. The portion of the driveway extending from New Sharon <br /> Church Road to the Lynn s residence has a 45 foot easement as recorded <br /> March 18, 1971 in the deed of easement in Orange County Book 672 page <br /> 272. The remainder of the driveway, leading to the house we wish to <br /> purchase, has a 50 foot easement according to Flat of Survey of E. B. <br /> Wood, Jr . dated October , 1987. Therefore we seek approval only for <br /> the 45 foot easement section as recorded . <br /> The entire driveway is densely wooded except for small clearings <br /> around the three houses. The driveway is dirt covered by gravel and <br /> is wide enough for two vehicles to pass one another . The driveway has <br /> accomodated the largest size moving van and would be able to <br /> emergency vehicles, if necessary. There is more than the 14 footle <br /> required power line and tree limb clearance. The driveway ends in a <br /> cul de sac immediately behind the house we wish to purchase. The cul <br /> de sac meets the minimum 70 foot diameter as required. <br /> The driveway is used by no other traffic than the residents of <br /> the three homes and is the only access to these residences. There are <br /> no current plans to expand the use of this road to other properties or <br /> homes. <br /> In summary, we wish to purchase a lot and accompanying home owned <br /> by Dr. William and Mary Lynn. We have already received an easement <br /> and road maintenance agreement for the entire driveway from the Lynns. <br /> We are requesting permission to use the existing driveway as it is <br /> with its 45 foot easement for the portion of the driveway from New <br /> Sharon Church Road to the Lynn ' s residence.
