9 <br /> 68.18 acres. The remaining 31.42 acres along the intermittent streams and <br /> on the northeastern portion of the site will be preserved as open space <br /> owned and maintained by a homeowners association. The property is zoned <br /> Rural Buffer and Protected Watershed II. The Joint Planning Area Land Use <br /> Plan designation is Rural Residential. The Planning Board recommends <br /> approval with five (5) conditions. The Administration added a sixth <br /> condition dealing with nitrification fields. <br /> The payment-in-lieu requirement was discussed and it was decided <br /> that in accordance with the ordinance a payment-in-lieu would be accepted <br /> and that a grant would be included in the budget next year which would <br /> return a like amount to the Habitat for Humanity. <br /> Motion was made by Commissioner Hartwell, seconded by Commissioner <br /> Carey to approve the Preliminary Plan for Chestnut Oaks with five <br /> conditions: <br /> (1) Indicate phase numbers for all open space areas. <br /> (2) The area for Lot 21 should be 50, 000 sq.ft. and not 500,000 <br /> sq.ft. <br /> (3) Submit restrictive covenants and Homeowners Association docu- <br /> ments for review and approval by the County Attorney. <br /> (4) Submission of payment-in-lieu of dedication of <br /> recreation/open space in the amount of $1,416. 00 prior to <br /> final plat approval. <br /> (5) Approval of permits for the community well system by the <br /> Orange County Health Department and/or the N.C. Department of <br /> Human Resources, Division of Health Services, as applicable, <br /> prior to final plat approval. <br /> VOTE: UNANIMOUS. <br /> It was the consensus of the Board that the County Manager, the <br /> Planning Director and the Health Director would meet and bring back to the <br /> Board for their consideration a policy for nitrification fields. <br /> It was the consensus of the Board that the payment-in-lieu would <br /> be handled as suggested by Chair Marshall and that consideration be given <br /> in next years budget for an allocation to the Habitat for Humanity. <br /> 8. QUAILVIEW SUBDIVISION - ACCEPTANCE OF LAND DEDICATED TO ORANGE <br /> COUNTY FOR RECREATION/OPEN SPACE PURPOSES <br /> Marvin Collins presented to the Board for acceptance the <br /> dedication of land for recreation/open space purposes. The land is <br /> approximately .76 acre on the south side of Neville Creek in Quailview <br /> Subdivision. This portion of Neville Creek had been approved as part of <br /> the system of parks and greenways included in the Joint Planning Area Land <br /> Use Plan. The Administration recommends acceptance of this land. <br /> Motion was made by Commissioner Hartwell, seconded by Commissioner <br /> Carey to accept a .76 acre tract of land dedicated to Orange County and <br /> located in the Quailview Subdivision for recreation/open space. <br /> VOTE: UNANIMOUS. <br /> 9. PINEY MOUNTAIN SUBDIVISION - ACCEPTANCE OF LAND DEDICATED TO <br /> ORANGE COUNTY FOR RECREATION/OPEN SPACE PURPOSES <br /> Marvin Collins presented to the Board for acceptance the <br /> dedication of land to Orange County for recreation/open space purposes in <br /> Piney Mountain Subdivision. The tract being dedicated at this time is 2.3 <br /> acres and is located on the east side of Piney Mountain Creek. The Admin- <br /> istration recommends acceptance of this land. <br /> Motion was made by Commissioner Willhoit, seconded by Commissioner <br /> Carey to accept 2 . 3 acres of land dedicated to Orange County and located <br /> in the Piney Mountain Subdivision for recreation/open space. <br />
