2 NCAC 9L . 1002 ; GENERAL REQUIREMENTS ; is proposed for amendment <br /> by the addition of (1 ) as follows : <br /> SUBCHAPTER 9L PESTICIDE SECTION <br /> (1 ) Any person who contracts for an aerial application of a <br /> pesticide shall provide individual and public notification not <br /> less than 72 hours °prior to the commencement of each such <br /> application . <br /> ( 1) Individual and public notification shall include at <br /> least the following information : <br /> (A) date and approximate time of day of the <br /> application; <br /> (B) brand name and EPA registration number of each <br /> pesticide to be applied; <br /> (C) name, address , and telephone number of the <br /> individual, firm, or corporation conducting the <br /> spraying; and <br /> (D) name, address, and telephone number of the <br /> individual contracting for the application. <br /> (2 ) For the purposes of this paragraph, individual <br /> notification is defined as written communication delivered to the <br /> head of household or, in his or her absence, to an inhabitant of <br /> legal age of any residence located within 1, 000 feet of the <br /> target area to be sprayed. Such written communication may be by <br /> means of: <br /> (A) U. S . mail ; or <br /> (B) notice left at residence. <br /> (3 ) For the purposes of this paragraph, public notification <br /> is defined as posting of clear warning signs to be in place at <br /> least 72 hours prior to commencement of the application: <br /> (A) at the corners and at a distance of every one-half <br /> mile along the perimeter of the target area to be ' <br /> sprayed; and <br /> (B) at a distance of every one-half mile along any <br /> public road located within one-half mile of the <br /> boundary of the target area to be sprayed. <br /> Statutory Authority G.S. 143-458; 143-466 <br />
