131 <br /> 8, 24, 25 , 26 and 27 be moved to within the 10 <br /> acre open space area adjacent to Jo Mac Road in <br /> order to provide further protection of the <br /> steeper sloped areas along the intermittent <br /> streams and to provide additional buffer area <br /> for the assimilation of pollutant runoff from <br /> the development. <br /> The steeper slopes on these lots average 10- <br /> 13% . Since these lots are being created for <br /> the purpose of providing affordable housing, <br /> the units will not be large, and grading will <br /> be kept to a minimum. The plan also meets the <br /> ordinance requirements for stormwater runoff <br /> management by using large lots, Iimited <br /> impervious surface, stream buffers, and <br /> retaining a buffer of vegetation around each <br /> lot to filter and absorb runoff. <br /> The Planning Staff recommends approval of the <br /> preliminary plan for Chestnut Oaks with the <br /> following conditions: <br /> 1 . Indicate phase numbers for all open space <br /> areas. <br /> 2. The area for Lot 21 should be 50, 000 sq. ft. <br /> and not 500, 000 sq. ft. <br /> 3 . Submit restrictive covenants and Homeowners <br /> Association documents for review by the <br /> County Attorney. <br /> 4. Submission of payment- in- lieu of dedication <br /> of recreation/open space in the amount of <br /> $1 ,416 . 00 prior to final plat approval . <br /> 5. Approval of permits for the community well <br /> system by the Orange County Health <br /> Department and/or the N. C. Department of <br /> Human Resources, Division of Health <br /> Services, as applicable, prior to final <br /> plat approval . <br /> Best asked about the maps with examples of <br /> slopes. Crudup indicated the slopes noting that <br /> they were a part of the lots and would be <br /> protected by PWII regulations and the tree <br /> protection areas which are the setbacks. <br /> Yuhasz asked how this subdivision meets the <br /> specific cluster provisions of the ordinance as <br /> far as how it looks and special design <br /> features. Crudup indicated that some open <br /> space had been reserved around the lots and <br /> stream buffers with natural areas around them. <br /> Best asked the percentage of undisturbed open <br /> space area. Crudup responded 45%. Best <br /> continued stating that this subdivision did <br />
