129 <br /> plan. Typical primary and secondary tree <br /> protection areas have been indicated on Lot <br /> #25 . The proposed layout meets necessary <br /> standards for stormwater management. An <br /> erosion control plan must be approved prior <br /> to issuance of a grading permit by Orange <br /> County. Individual house locations must be <br /> indicated when application is made for a <br /> building permit. <br /> 2. It is recommended that open space be <br /> utilized to protect slope areas greater <br /> than 15% . <br /> Much of the steeper slope areas are located <br /> in the proposed open space. <br /> 3 . Rather than make two stream crossings, the <br /> pedestrian path and roadway should be <br /> combined in one crossing. <br /> The location of the pedestrian footpath <br /> provides access to the preserved open <br /> space. This purpose could not be served as <br /> well if the path were located in the road <br /> right-of-way. <br /> The NC Department of Transportation approved <br /> the preliminary plan as proposed and will <br /> review construction plans prior to final plat <br /> approval . <br /> The Director of Orange County Recreation and <br /> Parks has reviewed the proposed dedication of <br /> recreation/open space and recommends that the <br /> space on the east side of Jo Mac Road be <br /> retained in private ownership by Habitat for <br /> Humanity or a Homeowners Association. This <br /> recommendation is in accordance with Section <br /> IV-B-10-d-a which states: <br /> a. Cluster recreation/open space shall be <br /> dedicated public unless the Board of <br /> Commissioners finds that the size, <br /> location, type or development or cost of <br /> development or maintenance of such space or <br /> the availability of public open/recreation <br /> space would make public use undesirable or <br /> unnecessary. <br /> The Planning Direct-or recommends payment- in- <br /> lieu of dedication in the amount of $1 ,416. 00 <br /> (31 lots x 1 /35th acre x $1 ,610/acre) . The <br /> cluster provision ( Section IV-B-10-d-a) allows <br /> negotiation regarding the public/private nature <br /> of the open space, but it does not exclude the <br /> applicant from the payment- in lieu provisions <br /> of Section IV-B-7- b- 6 . <br /> Orange Water and Sewer Authority provided a <br />
