106 4 <br /> The County is restricted to the requirements of the Health <br /> Department and the N. C. Division of Environmental Management <br /> insofar as the provision of dual absorption septic fields is <br /> concerned. There are no provisions in either the Zoning <br /> Ordinance or the Subdivision Regulations which would permit <br /> the inclusion of OWASA' s comments as conditions of approval . <br /> County policy regarding the extension of public water and <br /> sewer into the Rural Buffer and Protected Watershed areas <br /> also prevents reservation and/or dedication of utility <br /> easements for that purpose. Permits for construction of the <br /> community water system must be approved by the Department of <br /> Human Resources Division of Health Services prior to final <br /> plat approval . <br /> OWASA staff also recommended that Lots 5, 6, 7 , 8, 24, 25 , <br /> 26 and 27 be moved to within the 10-acre open space area <br /> adjacent to Jo Mac Road in order to provide further protec- <br /> tion of the steeper sloped areas along the intermittent <br /> streams and to provide additional buffer area for the <br /> assimilation of pollutant runoff from the development. <br /> The steeper slopes on these lots average 10-13% . Since <br /> these lots are being created for the purpose of providing <br /> affordable housing, the units will not be large, and grading <br /> will be kept to a minimum. The plan also meets the <br /> ordinance requirements for stormwater runoff management by <br /> using large lots, limited impervious surface, stream <br /> buffers, and retaining a buffer of vegetation around each <br /> lot to filter and absorb runoff . <br /> On January 25 , 1988, the Planning Board recommended approval <br /> of the preliminary plan for Chestnut Oaks subject to the <br /> following conditions : <br /> 1 . Indicate phase numbers for all open space areas. <br /> 2. The area for Lot 21 should be 50,000 sq. ft. and not <br /> 500,000 sq. ft. <br /> 3. Submit restrictive covenants and Homeowners Association <br /> documents for review and approval by the County <br /> Attorney. <br /> 4. Submission of payment- in- lieu of dedication of <br /> recreation/open space in the amount of $1 ,416.00 prior <br /> to final plat approval . <br /> 5. Approval of permits for the community well system by <br /> the Orange County Health Department and/or the N. C. <br /> Department of Human Resources, Division of Health <br /> Services, as applicable, prior to final plat approval . <br /> RECOMMENDATION: The Administration recommends approval as recommended by the <br /> Planning Board with one additional condition : <br /> 6. Indicate on the preliminary plan the primary and backup <br /> areas for nitrification fields as approved by the <br /> Orange County Health Department. <br />
