105 3 <br /> acres on the east side of Jo Mac Road to Orange County for <br /> recreation/open space purposes. The Recreation and Parks <br /> Director reviewed the preliminary plan and recommended that <br /> all of the proposed open space be retained in private <br /> ownership by Habitat for Humanity or a Homeowners <br /> Association. This recommendation is in accordance with <br /> Section IV-B-10-d-a which states: <br /> a. Cluster recreation/open space shall be dedicated public <br /> unless the Board of Commissioners finds that the size, <br /> location, type or development or cost of development or <br /> maintenance of such space or the availability of public <br /> open/recreation space would make public use undesirable <br /> or unnecessary. <br /> The Planning Director recommends payment- in- lieu of <br /> dedication in the amount of $1 ,416 . 00 (31 lots x 1/35th acre <br /> x $1 ,610/acre) . The cluster provision ( Section IV-B-10-d-a) <br /> allows negotiation regarding the public/private nature of <br /> the open space, but it does not exclude the applicant from <br /> the payment- in- lieu provisions of Section IV-B-7-b-6. <br /> Orange Water and Sewer Authority provided a written <br /> response which indicated that their standard comments <br /> regarding individual septic tanks and sedimentation and <br /> erosion control would apply to the preliminary plan of <br /> Chestnut Oaks. <br /> 1 . A dual absorption field system should be required to be <br /> installed at the time each lot is developed (alternat- <br /> ing use between the two fields on a regular basis) , <br /> with an additional back-up field area also being <br /> required. Supporting information on this approach is <br /> enclosed for your consideration. OWASA staff recog- <br /> nizes that this will result in increased construction <br /> costs and greater initial clearing for the system <br /> installation; however, the long-term benefits to water <br /> quality, public health and future owners of the <br /> property should offset these costs. <br /> 2. The primary and backup septic tank system sites identi- <br /> fied and approved by the Orange County Health Depart- <br /> ment should be clearly designated on the plats and <br /> deed/survey for each lot. These sites must be required <br /> to remain undisturbed and reserved by present and <br /> future owners for such use. OWASA has been informed of <br /> one reported case where a reserve site identified by <br /> the Health Department was rendered unusable due to <br /> construction of improvements after the initial resi- <br /> dence had been completed. <br /> OWASA expressed concern with long term maintenance of the <br /> proposed community water system. Consequently, the <br /> suggestion was made by OWASA staff that the system be <br /> designed and constructed in a way that would facilitate its <br /> use in the future if public water lines are ever extended to <br /> serve that area. <br />
