0t4 <br /> 2 <br /> on Jones Ferry Road ( SR 1942) . There are 4. 6 <br /> acres in the total tract with two (2) lots <br /> proposed. One lot will be 2. 1 acres and the <br /> other lot 2. 5 acres. Both lots will have <br /> frontage on Jones Ferry Road. The property is <br /> located in the University Lake Watershed and <br /> zoned Rural Buffer. <br /> All applicable agencies have reviewed the <br /> preliminary plan. <br /> The Recreation Department indicated a need to <br /> specify that the recreation area is dedicated to <br /> Orange County for public recreation and <br /> park/open space purposes. <br /> Carrboro has indicated several concerns. A 100 <br /> foot buffer area would be required along the <br /> stream in their Jurisdiction, however, the <br /> buffer proposed meets Orange County <br /> requirements. The house and existing driveway <br /> are shown for lot 9B, however, the house site <br /> for lot 9A has not been determined. The tract <br /> is totally wooded with proposed clearing areas <br /> to include the driveways and house sites. OWASA <br /> and Carrboro both indicated a need to show <br /> septic field areas. This has been designated on <br /> the revised preliminary plan for lot 9B. <br /> At the December 21 , 1987 meeting of the Planning <br /> Board, consideration of the preliminary plat was <br /> continued to this meeting to permit the Planning <br /> Staff to review the restrictive covenants <br /> governing Phase I of Lake Woods Subdivision. The <br /> preliminary plat for Lake Woods Subdivision was <br /> approved by the Planning Board on April 16, 1984 <br /> and by the Board of Commissioners on May 7, <br /> 1984. The final plat for Phase I of Lake Woods <br /> Subdivision was approved by the Planning Board <br /> on July 16, 1984. There is no reference to any <br /> approval being based on a condition that the <br /> restrictive covenants limit the lot size to a <br /> certain area or to preventing further <br /> subdivision of the property. The deed <br /> restrictions do limit subdivision of the lots to <br /> not less than two acres in size. <br /> The County Attorney has provided information <br /> regarding the relationship between restrictive <br /> covenants and subdivision review and approval . <br /> ( See County Attorney 1 /4/88 Letter included on <br /> pages of these minutes) . <br /> The Planning Staff recommends approval with the <br /> following condition: <br /> 1 .
