4 <br /> (8) Lawn mowers and agricultural equipment used <br /> between daylight and 9 P.M. when operated with all <br /> the manufacturers' standard mufflers and noise <br /> reducing equipment in use and in proper operating <br /> condition. <br /> (9) Agricultural equipment operated for farming <br /> purposes. <br /> Article V: Permit to Exceed Maximum Permissible Standards <br /> (1) A person or group of persons intending to operate <br /> or cause to be operated a source of sound in <br /> excess of sound levels not requiring a permit as <br /> specified in Article II, must apply for a permit. <br /> (2) Any Person or persons desiring a permit shall <br /> apply as provided herein and provide all <br /> information required. <br /> (a) The applicant must apply for a permit at <br /> least forty-eight (48) hours prior to the <br /> activity for which the permit is requested. <br /> (b) The Orange County Manager, or his designee, <br /> will act upon all requests for a permit to <br /> exceed maximum permissible standards. <br /> (c) In considering and acting on all requests <br /> for permits pursuant to this article, the <br /> Manager shall consider, but shall not be <br /> limited to, the following in issuing or <br /> denying such permit: the timeliness of the <br /> application; the nature of the requested <br /> activity; previous experience with the <br /> applicant; the nature of the event; the time <br /> of the event; other activities in the <br /> vicinity of the location proposed; the <br /> effect of the activity on surrounding areas; <br /> previous violations, if any, of the <br /> applicant. <br /> (d) Upon receipt of a permit to exceed maximum <br /> permissible unpermitted sound levels, the <br /> applicant will pay to Orange County an <br /> administrative fee of $5. 00. <br /> (e) Permit holders agree to cooperate with the <br /> Orange County Sheriff's Department in <br /> enforcing this ordinance by having the <br /> applicant available at the site of the event <br /> during the entire time for which a permit <br /> has been issued or being capable of <br /> assisting the Sheriff in enforcing this <br /> Ordinance. Failure of the applicant to be <br /> present or to assist the Sheriff as herein <br /> prescribed shall be cause for revocation of <br /> the permit. <br />
