The subdivision roads, even if <br /> constructed to State standards, would not <br /> be accepted by the State for maintenance <br /> due to density or some other State <br /> requirement that the subdivision cannot <br /> meet; and <br /> WHEREAS, Section IV-B-3-d also states that for a subdivision <br /> to be approved with private roads, it should meet <br /> as many of the above criteria as possible; <br /> provided, however, the meeting of one or more of <br /> the specified conditions will not insure automatic <br /> approval of private roads; and <br /> WHEREAS, the interpretation and application of the private <br /> road standards has not been in accord with the <br /> intent of the ordinance provisions; and <br /> WHEREAS, confusion has arisen among applicants for <br /> subdivision approval , the Planning Board, the Board <br /> of Commissioners and the County staff as to the <br /> proper interpretation and application of the <br /> private road standards; and <br /> WHEREAS, clarification of the interpretation of the private <br /> road standards is necessary to insure consistency <br /> of application and expeditious handling of <br /> subdivision applications ; and <br /> WHEREAS, an interim policy for the interpretation and <br /> application of the private road standards is needed <br /> until specific ordinance amendments are prepared <br /> and considered for approval : <br /> NOW, THEREFORE, BE IT RESOLVED by the Orange County <br /> Planning Board that : <br /> 1 . The following design features will be <br /> considered in determining whether to permit <br /> private roads in subdivisions : <br /> a. The location and design of the <br /> subdivision is such that it clearly <br /> preserves the rural character of the <br /> County through : <br /> ( 1 ) The provision of lot sizes and <br /> building setback lines greater than <br /> required by ordinance provisions; <br /> (2) The retention and/or provision of <br /> landscaping and use of clustering of <br /> dwelling units to screen the view of <br /> the subdivision from public roads <br /> and/or maintain a wooded or forested <br /> character; <br />
