If major <br /> modifications were necessary, an amendment to the special use <br /> permit would be required. ) <br /> 3. Provide assurance that open space areas will not be developed. <br /> (Open space areas, including recreation space and nitrification <br /> fields, must be maintained permanently for wastewater system and <br /> special use permits to remain valid. Provisions could be <br /> required as part of the restrictive covenants will restrict <br /> development of open space areas. ) <br /> 4. Provide assurance that sedimentation and erosion control <br /> measures will be installed in a timely manner and permanently <br /> maintained. <br /> ( Sedimentation and erosion control plans must be submitted and <br /> approved prior to any site disturbance. The applicant has <br /> proposed that the wastewater utility or the County provide <br /> maintenance to permanent control measures. The County will not . <br /> access responsibility for such maintenance, thus requiring the <br /> wastewater utility or a homeowners association to provide <br /> permanent maintenance. ) <br /> 5. Public utility easements should be obtained to facilitate the <br /> provision of public sewer services in the event such extension <br /> is determined necessary in the future. <br /> (Orange County ' s current policy is to prohibit the extension of <br /> public water and sewer service into protected watersheds and the <br /> Rural Buffer. Should this policy be amended, the County may then <br /> proceed to seek utility easement reservations. ) <br />
