Permit was invalid since the applicant did not <br /> 23 o meet the required two-acre minimum lot size <br /> standard, and since evidence had not been <br /> presented to indicate the project would main- <br /> tain the value of existing properties in the <br /> area. The effect of the court ruling was to <br /> place Chandler Concrete Company in violation of <br /> , the Orange County Zoning Ordinance. <br /> 10/15/87 <br /> The Board of Commissioners approved a request <br /> by Chandler Concrete to expand the Ten-Year <br /> Transition Area and Commercial - Industrial <br /> Activity Node by an additional 0. 59 acres. <br /> Combined with the 1 . 41 acres currently in the <br /> same designation, the two-acre lot size <br /> requirement could be met. <br /> NCDOT has indicated that a driveway permit will <br /> be required for driveway "D" ( the easternmost <br /> driveway) . This permit has been obtained and <br /> the driveway constructed. Encroachment agree- <br /> ments will be required if any drainage <br /> structures or other work is performed within <br /> the right-of-way of Old NC Highway 10. <br /> Both the Orange Rural Fire Department and the <br /> Orange County Rescue Squad have indicated their <br /> ability to provide emergency services to the <br /> site. The Sheriff ' s Department has indicated <br /> that no additional manpower will be needed. <br /> The Erosion Control Officer has indicated that <br /> a stormwater management plan will be . required <br /> for the project. The Recreation Director has <br /> indicated no elements exist which would warrant <br /> comment from a recreation perspective. <br /> The Planning Staff recommends approval of the <br /> request with conditions as listed (attachment <br /> to these minutes on pages ) . <br /> FINDINGS OF FACT <br /> MOTION: Best moved positive findings on Articles 8. 6, <br /> 8. 8 and 7.4. (These are application components <br /> and specific standards for evaluation/planned <br /> developments) .
