2 <br /> 209 12/12/86 - Following a challenge to Orange County ' s <br /> approvals, the court ruled that the Special Use <br /> Permit was invalid since the applicant did not <br /> meet the required two-acre minimum lot size <br /> standard, and since evidence had not been <br /> presented to indicate the project would maintain <br /> the value of existing properties in the area. <br /> The effect of the court ruling was to place <br /> Chandler Concrete Company in violation of the <br /> Orange County Zoning Ordinance. <br /> 10/5/87 - The Board of Commissioners approved a request by <br /> Chandler Concrete to expand the Ten-Year <br /> Transition Area and Commercial - Industrial <br /> Activity Node by an additional 0. 59 acres. <br /> Combined with the 1 .41 acres currently in the <br /> same designation, the two-acre lot size <br /> requirement could be met. <br /> NCDOT has indicated that a driveway permit will be required <br /> for driveway "D" (the easternmost driveway) . This permit <br /> has been obtained and the driveway constructed. <br /> Encroachment agreements will be required if any drainage <br /> structures or other work is performed within the right-of- <br /> way of Old N. C. Highway 10. <br /> Both the Orange Rural Fire Department and the Orange County <br /> Rescue Squad have indicated their ability to provide <br /> emergency services to the site. The Sheriff ' s Department <br /> has indicated that no additional manpower will be needed . <br /> The Erosion Control Officer has indicated that a stormwater <br /> management plan will be required for the project. The <br /> Recreation Director has indicated no elements exist which <br /> would warrant comment from a recreation perspective. <br /> At its December 21 , 1987 meeting, the Planning Board <br /> recommended approval of rezoning of the property from R-1 <br /> Residential and PD- I- I -3 to PD- I- I-1 and the issuance of a <br /> Class A Special Use Permit with conditions. ( See <br /> attachment. ) <br /> RECOMMENDATION: The Administration recommends approval of the request as <br /> recommended by the Planning Board. <br />
