2 <br />ERCD staff has worked with the State and the County Attorney to prepare a draft <br />conservation easement agreement that meets. the needs all affected parties. The easement <br />will accommodate the planned River Park, Farmers Market structure, courthouse expansion, <br />and future maintenance of pedestrian bridges and utility crossings. <br />The Orange Soil & Water Conservation and ERCD staffs intend to use this project for <br />environmental education programs that will include signage and teaching areas to explain the <br />purpose and process of the stream restoration project. <br />FINANCIAL IMPACT: There would be no County expenditures to implement this action. <br />The conservation easement would be administered by the Environment and Resource <br />Conservation Department, which would entail periodic monitoring of the easement area and <br />reporting findings and recommendations to the appropriate parties. <br />RECOMMENDATION: The Manager recommends that the Board adopt the resolution <br />approving the granting by Orange County of the conservation easement and authorize the <br />Chair and the Clerk to sign the conservation easement agreement, subject to final review by <br />staff and county attorney, with a closing and recordation of the document expected to occur <br />on or about April. 30, 2007. <br />
