052 <br /> (a) Upon a showing by Agency that actual casks have increased due to <br /> factors beyond Agency's control; or <br /> (b) Upon a showing by Agency that actual costs have increased due to a <br /> sudden increase in client load (e.g., due to a disaster event). <br /> The parties further agree that COG shall have the right to decrease the <br /> reimbursement rate under any circumstances which show that actual costs are <br /> less than projected; including, but not limited to, circumstances in which: <br /> (a) Overall costs of providing service are shown to be less than forecast in <br /> the Agency's original bid for this service; tr <br /> (b) The Agency fails to document the required local match such that the <br /> COG reimbursement rate exceeds ninety percent (90%) of service costs. <br /> In the event the reimbursement rates are decreased, COG may, at its <br /> option, increase the total number cf units cf service to be delivered. <br /> 11. Payments by Service Recipients. No individual receiving services under <br /> the terms of this Agreement shall be required to pay any part of the cast of the <br /> service. However, recipients shall be given the opportunity by the Agency to <br /> make some contribution for the service in a manner approved by COG. <br /> Agency shall post a notice in a conspicuous place, stating that no charge <br /> is made for the service, but that contributions will be accepted. Agency shall <br /> furnish envelopes to all clients for confidential contributions. Agency shall offer <br /> a locked box in a convenient location for confidential deposit cf envelopes. All <br /> envelopes shall be collected and operated by the Project manager or a person <br /> designated by the Project Manager. Envelopes shall be opened in the presence of <br /> another person, the money shall be counted and the total recorded. The money <br /> shall be deposited in accordance with the usual procedures of the Agency, with a <br /> separate receipt., Accumulation of contributions should not exceed fifty dollars <br /> ($50) between deposits. <br /> 12. Program Income. Program income is any money received by Agency as <br /> a direct result of contract activity. Agency shall maintain daily records of <br /> voluntary contributions by (or on behalf of) service recipents, interest received <br /> on COG advance before disbursement, and any other program income. Agency <br /> shall not withold any program income as an offset to COG reimbursement <br /> Program income shall be used in the same year it is received to provide <br /> additional services. Upon completion of the work, including the receipt of any <br /> final written submission cf the Agency, COG shall pay the Agency a sum equal <br /> to one hundred percent (100%) of the compensation to be paid under this <br /> contract, lei the total of all previous payments made. <br /> Notwithstanding the foregoing provisions of this paragraph, COG will make <br /> diligent efforts to obtain advance funding from its funding source; and if it <br /> receives such advance funding, then the Agency shall be entitled to advances <br /> once a month based upon requisitions of the estimated amounts of expected <br /> expenditures for such month. <br /> 13.
