23t <br /> WHEREAS, the CITY in the future may have a need for water from <br /> the TOWN to serve certain areas within the CITY ' s service area <br /> when a failure in the CITY' S water supply, distribution or treat- <br /> ment system creates an emergency for the CITY. <br /> NOW, THEREFORE, in consideration of One Dollar ($1.00) and the <br /> benefits and detriments moving between the parties, and <br /> especially in consideration of making a cooperative effort to <br /> alleviate water shortages, the CITY and the TOWN, for themselves, <br /> their successors and assigns, do mutually agree as follows: <br /> 1. A water and sanitary sewer service area boundary line is <br /> hereby established as described in Attachment A and shown on <br /> Attachment B. It is understood and agreed that the area located <br /> west of the boundary line shall receive water and sanitary sewer <br /> service from the TOWN and the area located east of the boundary <br /> line shall receive water and sanitary sewer service from the <br /> CITY. <br /> 2. Either party may extend water and/or sanitary sewer lines or <br /> facilities in the other party' s service area to the extent such <br /> action is necessary and reasonable provided that sixty (60) days <br /> prior written notice shall be given and said facilities shall not <br /> be used to serve any customers located within the other party' s <br /> service area. <br /> 3 . The TOWN shall , as the contracting agent for the City, extend <br /> a water main in U.S. Highway 170 from the end of the CITY ' s <br /> -2- <br />
