Section 4 states <br /> that the maximum amount of water to be supplied by <br /> Hillsborough to Durham shall be 1 . 0 million gallons per <br /> day subject to the limitations of Section 11 . <br /> As Ken Thompson has noted in his 6/2/67 memorandum, <br /> constraints on the ability of Hillsborough to provide <br /> the water to Durham are not identified . In particular, <br /> County ordinances limit withdrawals from the Eno River <br /> at Hillsborough . <br /> G <br /> Based on my evaluation of the agreement, I recommend the <br /> following : <br /> 1 . That Orange County contact the City of Durham and the <br /> Town of Hillsborough for the purpose of seeking <br /> revisions to the agreement which provide assurances that <br /> no connections will be permitted to the water line <br /> except in 10 and 20-year Transition Areas as designated <br /> on the Orange County Land Use Plan or in emergency <br /> situations for properties located outside such <br /> Transition Areas. <br /> 2. That Orange County contact the City of Durham for the <br /> purpose of seeking revisions to its Urban Growth <br /> Boundary which are consistent with the 10 and 20-year <br /> Transition Areas of the Orange County Land Use Plan. <br /> 3 . That Orange County contact the City of Durham and the <br /> Town of Hillsborough for the purpose of seeking <br /> revisions to Section 11 of the agreement which clearly <br /> define the limits of transmission of water from the Town <br /> of Hillsborough to the City of Durham, and that such <br /> limits be based in part on the limits for withdrawals <br /> from the Eno River. <br /> If revisions to the agreement cannot be secured, I recommend <br /> that the Board of Commissioners adopt the Planning Board ' s <br /> recommended policies pertaining to water/sewer extensions <br /> outside of approved service areas. <br /> The Planning Board will consider this matter at its July 14, <br /> 1957 meeting. Its recommendations will be forwarded to you <br /> promptly. If you have questions, please advise. <br />
