INTEROFFICE MEMORANDUM: 8707-1811 <br /> Durham-Hillsborough Minter Line Agreement <br /> 194 July 8, 1987 <br /> Page 3 <br /> references are made to a service area and boundary line for <br /> water and/or sewer. (see Sections 1 , 2 and 3 . ) The service <br /> area boundary is depicted on maps provided as part of the <br /> agreement as well as with the 6/ 18/87 notification letter <br /> received from the Durham Engineering Department. It appears <br /> that the line follows the proposed 100-year service area <br /> boundary being contemplated by Hillsborough as part of its <br /> water/sewer services plan . <br /> I have denoted on a portion of the Land Use Plan the location <br /> of the service area boundary and the Durham Growth Area <br /> Boundary adopted as part of its 2005 Comprehensive Plan. <br /> As i understand the agreement, both Durham and Hillsborough <br /> would be permitted to make extensions from the inter <br /> connecting line. Such extensions would be permissible under <br /> the Orange County Land Use Plan within defined 10 and 20-year <br /> Transition Areas. However, there are vast areas to the north <br /> and south of the proposed water line which are designated <br /> Rural Residential . In such areas, low-density residential <br /> development is anticipated and urban services, including <br /> water and sewer, are not expected within the twenty year <br /> planning period. The extension of water lines from the <br /> Durham--Hillsborough inter-connection into areas designated <br /> Rural Residential would be a clear departure from the intent <br /> of the Land Use Plan. <br /> Two other points worth noting include the following : <br /> 1 . The cover letter for the agreement clearly states that <br /> the Durham-Hillsborough connection would be an exception <br /> to the Urban Growth Policy of the Durham 2005 <br /> Comprehensive Plan. However, Section 3. j. of the <br /> agreement states that connections east of the service <br /> area shall be in accordance with the Urban Growth <br /> Policy. <br /> Excerpts from the Durham 2005 Comprehensive Plan have <br /> been provided which identify the policy. The Urban <br /> Growth Area (UGA) is that land which can be expected to <br /> develop an urban character over the next 20 to 30 years. <br /> The policy relating to the UGA and development prohibits <br /> extension of water and sewer service to property outside <br /> the UGA. <br /> A basic question is - If Durham will approve a <br /> connecting water line to Hillsborough as an exception to <br /> its Urban Growth Policy, will they make other exceptions <br /> for connections to the line? <br /> 2. Section 11 of the agreement states that Hilisborough > <br /> upon written request by Durham, shall furnish whatever <br /> amount of water it determines it is capable of providing <br />
