16� <br /> 2 <br /> e ) the subdivision roads , even if constructed to <br /> State Standards, would not be accepted by the <br /> State for maintenance due to density or some <br /> other State requirements that the subdivision <br /> cannot meet. <br /> EVALUATION <br /> In applying these conditions to Saddle Creek subdivi- <br /> sion, the Planning Department notes the following : <br /> 1 . The proposed subdivision is part of a much larger <br /> tract. Therefore, Lee Street has the potential to <br /> be extended in the future. Vinca Lane, however, <br /> probably will not be extended because of the <br /> topography and a nearby stream to the west. <br /> 2 . a ) The subdivision consists of less than ten ( 10 ) <br /> lots . <br /> b ) The subdivision does not preserve a natural <br /> area . <br /> c) The subdivision does not include or abut any <br /> part of a thoroughfare or street shown on the <br /> Orange County thoroughfare plan or on the <br /> thoroughfare plan of an Orange County munici - <br /> pality . It does not lie within a designated <br /> transition area determined by the County . <br /> d ) The subdivision joins an existing subdivision <br /> where the street (Lee Street) is unpaved . <br /> e) If the roads were constructed to NCDOT stan- <br /> dards, the state would accept them for main- <br /> tenance provided the density requirement (2 <br /> houses per 528 feet) could be met. <br /> • <br /> RECOMMENDATION <br /> The subdivision satisfies three of the five conditions <br /> required for the designation of a private road. The Planning <br /> Staff recommends that the proposed roads be approved as <br /> follows: <br /> Vince Lane, a Class B private road <br /> Lee Street, a Class A private road <br /> Further subdivision of parcels served by these roads <br /> would result in the necessary upgrading of the roads. This <br /> process would be outlined in the Road Maintenance Agreement <br />
