Mr. Marvin Collins <br /> May 27 , 1987 <br /> Page Two <br /> the established discharge limit for a particular water body has been assigned <br /> already or because the body into hch waste water would otherwise <br /> discharged has been assifiedeitherasazeroflowstream (meaningthat <br /> once in approximately ten (10) years the stream will be dry due to absence of <br /> rainfall) or as a nutrient sensitive water body. <br /> Based on technology, North State is distinguishable from other private <br /> sewer utility companies that exclusively, or primarily, operate discharge sewer <br /> systems, specifically package plants (i.e. miniature municipalisewerhsyste s) , <br /> which discharge treated, but nevertheless impure, waste <br /> waters of the State. NSU' s technology is primarily concerned with sewage treatment <br /> as the ultimate method of disposal and, in achieving this goal, recognizes that <br /> all human waste is treated in the final analysis ythe soil. <br /> and contrast,package <br /> conventional discharge sewer systems, including both <br /> plants, are primarily a product of historical development and, thus, evolved <br /> from being principally concerned with the removal and disposal of sewage into <br /> treating sewage. Specifically, conventional discharge systems operate by <br /> transporting waste primarily by force of gravity following natural contours <br /> along drainage ways, creeks, streams, and rivers '(i.e. evolution from open sewers <br /> to sewer pipes) to a central treatment location (i.e. evolution from removal <br /> to treatment) where solids are removed in the form of sludge and the treated, <br /> but impure, waste water is discharged into surface waters. The impurities in <br /> the discharged water ultimately settle to the bottom of the river (or the sound <br /> or ocean into which it empties) and are then treated by the soil through chemical <br /> reactions. Similarly, the sludge is normally applied to the soil as fertilizer, <br /> often to grow corn. <br /> NSU REGULATION <br /> North State is a licensed, regulated public utility company in the State <br /> of North Carolina. Accordingly, NSU is subject to the jurisdiction of and is <br /> regulated by the North Carolina Utilities Commission. <br /> North State's currently approved "Uniform Statewide Rate" for sewer service <br /> for residential units is a flat (i.e. unmetered) rate of $18.00 per house per <br /> month. NSU presently holds Certificates of Public Convenience and Necessity <br /> (i.e. Franchises) for sewer systems for six (6) subdivisions involving service <br /> to more than three hundred (300) individual residences. Projects presently <br /> in various stages of design for which Certificates of Public Convenience and <br /> Necessity will be requested upon completion of design involve sewer service <br /> for more than five hundred (500) additional residences. North State has never <br /> had an Application for a Certificate of Public Convenience and Necessity denied <br /> by the Utilities Commission. Furthermore, North State is not aware of any complaints <br /> ever having been filed with the Commission regarding rates, quality of service, <br /> or other matters. <br />
