D � a7 <br /> 1 O{i <br /> Lewis inquired if this project could be presented <br /> to the Board of Commissioners with the concerns of <br /> some Planning Board members regarding Duke Forest. <br /> Gledhill noted that the concerns could be presented <br /> but that something you do not know about should not <br /> be added as a condition . <br /> Collins noted that he had some concerns about the <br /> situation regarding Duke Forest. He stated that a <br /> formal policy had never been established which <br /> states that Staff must solicit comments from Duke <br /> Forest. Another concern was the rural buffer. He <br /> noted that at the public hearing regarding the <br /> Joint Planning Areal Land Use Plan, comments were <br /> solicited from Duke Forest. They indicated that <br /> they wanted the rural buffer adjacent to their <br /> properties with a two-acre minimum lot size. He <br /> continued that Mr. 01N-eal had presented a cluster <br /> development which complies with all County regu- <br /> Iations. Collins stated that this tract drains <br /> away from Duke Forest and that he felt Mr. O' Neal <br /> had made every effort to address the ordinance <br /> concerns and provide the information required by <br /> the County . Collins noted he felt it would be <br /> inopportune to postpone a decision on the project <br /> simply because of Duke Forest. <br /> Jacobs stated that he felt the Board did have an <br /> established policy on comments from Duke Forest. <br /> He felt that since this could not be added as a <br /> condition, he was willing to abide by the Board ' s <br /> decision . However, he did request that the Staff <br /> solicit comments from Duke Forest and include those <br /> comments in the presentation to the Board of <br /> Commissioners. <br /> Pilkey noted again her concerns about the soil <br /> suitability. Mr . O' Neal responded that the review <br /> process for the sewage disposal system is a State <br /> review process in which all the information <br /> regarding soils and soil suitability is provided. <br /> He indicated that since this was a State process, <br /> he was not aware that such information would be <br /> required for the preliminary process. He noted <br /> that North State Utilities is a public utility and <br /> will own and operate the sewage disposal system and <br /> thus have full responsibility for the system. <br /> MOTION : Yuhasz moved that the Piney Mountain Cluster <br /> Preliminary Plan be considered . Seconded by Lewis. <br /> VOTE: 5 in favor (Boland, Lewis, Swann, Taylor, Yuhasz ) . <br /> 4 opposed ( Jacobs, Best, Pilkey, Kramer) . <br /> Jacobs asked Mr. O' Neal if he was in agreement that <br /> the left turn lane be constructed as part of Phase <br /> I and Mr . O' Neal agreed . <br />
