Mr. O' Neal expressed concern with a <br /> further delay and the costs incurred by the <br /> delay . <br /> Staff presentation by Crudup. <br /> This agenda item is for the consideration of <br /> the preliminary plan for Piney Mountain, a <br /> cluster subdivision . <br /> The property is located on the northeast side <br /> of Mt. Sinai Road ( SR 1718 ) approximately one <br /> half mile west of the Orange/Durham County <br /> line. The tract 1s zoned Rural Buffer and <br /> designated Rural Residential on the Joint <br /> Planning Area Land Use Plan . It is adjacent to <br /> Mt. Sinai Baptist Church and bordered on the <br /> east side by Piney Mountain Creek . <br /> The total acreage of the tract is 128. 56 <br /> acres. As a cluster subdivision , 59 lots are <br /> proposed in two phases. The remaining acreage <br /> ( excluding road right-of-way) will be preserved <br /> in a system of open space. The average lot <br /> size is 1 . 12 acres. Each lot will be served by <br /> public roads and by common nitrification fields <br /> for septic tank disposal . The entire sewage <br /> disposal system will be owned, operated and <br /> maintained by North State Utilities, Inc. ( see <br /> attached letter) . The applicant proposes to <br /> dedicate to Orange County approximately 14 <br /> acres on the east side of Piney Mountain Creek <br /> to be used for recreation/greenway purposes. <br /> All agencies have reviewed the preliminary <br /> plan. Permits for construction of the sewage <br /> disposal system must be approved by the N. C. <br /> Department of Environmental Management prior to <br /> final plat approval . <br /> The Town of Chapel Hill Planning Department has <br /> provided courtesy review comments as follows : <br /> 1 . We are concerned about the proximity of the <br /> nitrification fields to the existing pond . <br /> Will the pond continue to be used for <br /> recreation purposes? <br /> 2 . Should the ownership of the nitrification <br /> fields be transferred to the company which <br /> will be responsible for the sewage system? <br /> We believe this could be a concern <br /> particularly if that company later <br /> "dissolved . " Perhaps the homeowners <br /> associations should retain title. <br /> 3 . We recommend that a sign be posted at the <br />
