Information from Warren Faircloth regarding detention <br /> ponds. <br /> The applicant agreed to make efforts to address these <br /> agreed reihearhethepPreliminarynPlan, requestnatngitsoMay <br /> agre <br /> 18, 1987 meeting. <br /> Subsequently, the Planning Board recommended approval of the <br /> Preliminary Plan for Sunset Ridge - Section II subject to <br /> the following conditions : <br /> ( 1 ) Revision of preliminary plan or provision of separate <br /> landscape plan identifying stands of existing trees and <br /> those trees to be preserved upon project completion, <br /> specifying location, species, and approximate size. <br /> (2) Provide typical landscaping detail plans in accordance <br /> with Section IV-B-8-c of the Subdivision Regulations <br /> for those areas where existing landscaping is not <br /> available. <br /> (3) Submittal to and approval by the County Attorney of <br /> covenants and restrictions, articles of incorporation <br /> and/or by- laws for the homeowners association that will <br /> govern the maintenance and control of the common areas. <br /> The homeowners association agreement shall be submitted <br /> to the Planning Board prior to final plat approval and <br /> shall spell out maintenance recommendations from the <br /> County Erosion Control Officer and shall specify that <br /> the developer will contribute to the homeowners <br /> association in accordance with the number of lots the <br /> developer owns . <br /> (4) Lots 1 , 8, 21 , 33, 34, 37 and 38 must be combined with <br /> other lots or labeled as of restricted development <br /> potential as required by Section III -E-5-e of the <br /> Subdivision Regulations. If labeled, an instrument <br /> must also be recorded with the Final Plat which <br /> describes the restricted lots by metes and bounds . <br /> (5) Prior to final approval , the Orange County Planning <br /> - Board reserves the right to review and make additional <br /> conditions based on courtesy review recommendations <br /> from the Town of Mebane Planning Board. <br /> RECOMMENDATION: The Manager recommends approval of the preliminary plan with <br /> conditions 1 -4 as recommended by the Planning Board. Since <br /> the Town of Mebane has chosen not to respond due to the site <br /> being located outside of its extra-territorial planning <br /> jurisdiction, the approval should not be based upon receipt <br /> of further comments from the Town of Mebane. <br />
