P <br /> AN ORDINANCE AMENDING A FRANCHISE <br /> TO PRIME CABLE INCOME PARTNERS L.P. <br /> (HEREINAFTER CAROLINA CABLE) <br /> (PREVIOUSLY VILLAGE CABLE OF <br /> ORANGE COUNTY, INC. ) TO <br /> CONSTRUCT AND MAINTAIN A <br /> CABLE TELEVISION SYSTEM WITHIN THE <br /> UNINCORPORATED AREAS OF ORANGE COUNTY, <br /> NORTH CAROLINA <br /> THE BOARD OF COMMISSIONERS OF ORANGE COUNTY, NORTH CAROLINA <br /> ORDAINS: <br /> Section IX of the franchise ordinance is amended by amending <br /> the line extension commitments contained in Section H of the <br /> proposal of Village Cable of Orange County, Inc. to eliminate any <br /> requirement for "overbuilding. " The term "overbuilding" as used <br /> herein shall mean: notwithstanding the extension policy required <br /> herein and as proposed by grantee, grantee shall not be required <br /> to "overbuild. " The term "overbuild" as used herein shall mean <br /> paralleling with Feeder Line the Feeder Line of another <br /> franchised cable operator in the unincorporated areas of the <br /> county in order to serve dwellings along the paralleled Feeder <br /> Line already served by the other franchised cable operator. This <br /> authority not to overbuild shall not: <br /> 1. relieve grantee of its responsibility and duty to <br /> parallel Main Trunk Cable in order to serve all areas of the <br /> unincorporated areas of the county which meet the density <br /> standards of this franchise; <br /> 2. relieve grantee of its responsibility and duty to <br /> parallel with its Feeder Line the Feeder Line of another <br /> franchised cable operator in order to reach areas of the <br /> unincorporated areas of the county where there are no parallel <br />
