r <br /> Board of Commissioners Page Two May 15, 1987 <br /> presumably because there has been no perceived need . <br /> Should the need arise in the future, the ordinance can <br /> be amended to include provisions for rate review <br /> consistent with the Cable Communications Policy Act. <br /> Section X of the ordinance as it now reads <br /> contains a procedure for extension of service into <br /> previously unserved areas of the County which does not <br /> fit the extension policies in the franchise of Carolina <br /> Cable and the proposed franchise of Alert . Extensions <br /> in the County are accomplished through density <br /> requirements . Therefore I propose that the portions of <br /> the ordinance related to other service extension plans <br /> be eliminated to avoid confusion. <br /> I propose that the County receive 5% of the gross <br /> annual receipts of the franchised cable operators . <br /> This compares to 3% which is presently the remuneration <br /> to Orange County. Section 542 of the Cable <br /> Communications Policy Act of 1984 authorizes a <br /> franchise fee not to exceed 5% of the cable operators <br /> gross revenues derived from the operation of the cable <br /> system. <br /> I have proposed an expansion of the service and <br /> maintenance provisions (Section XV) to include more <br /> specific maintenance service requirements particularly <br /> in the event of system-wide failures and system-wide <br /> failures during prime time. In the same section I have <br /> proposed specific complaint resolution procedures and a <br /> requirement that all calls for service be logged and <br /> submitted to Orange County on a regular basis . <br /> Finally, with respect to the ordinance, I have <br /> expanded the violations section (Section XVII) to <br /> include a provision for civil penalties and provisions <br /> for enforcement by injunction. <br /> The proposed franchise ordinance for Alert <br /> contains all of the recommendations of the Cable TV <br /> Advisory Committee together with ideas expressed by the <br /> Board and individual Board members during and following <br /> the Cable TV Advisory Committee ' s presentation to the <br /> Board . Notably there are provisions for system <br /> improvements , compatibility with other franchises , an <br /> expansion of local origination programming to include <br /> bi-directional capability to and from Hillsborough and <br /> cooperation with other cable franchisees in order to <br /> expand the availability of local programming. I have <br /> also proposed establishing the expiration date of the <br /> term of the franchise to be contemporaneous with the <br /> P <br />
