An Orange County Cable Television System <br /> Ordinance; <br /> 2 . A proposed franchise ordinance for Alert <br /> Cable TV of North Carolina, Inc . ; and <br /> 3 . An amendment to the franchise ordinance for <br /> Carolina Cable (formerly Village Cable of Orange <br /> County, Inc. ) . <br /> The cable television system ordinance has a number <br /> of proposed additions and deletions . I have taken the <br /> time to update the ordinance to reflect current <br /> thinking of the board, the cable television industry <br /> generally and changes in the law. All proposed <br /> additions are highlighted with underlining . All <br /> proposed deletions are lined through . Most <br /> significantly I propose all sections related to County <br /> involvement in rates be eliminated from the ordinance . <br /> Orange County ' s ability to regulate rates has been all <br /> but preempted by the Cable Communications Policy Act of <br /> 1984 , 47 U.S.C. Section 521 et seq. (1984) and the <br /> regulations promulgated under Section 543 of the Act. <br /> Rates have not been a problem in Orange County and I <br /> don ' t anticipate they will be. The cable operators <br /> will keep rates low and competitive in order to obtain <br /> subscribers . Furthermore , the procedure set out in the <br /> cable television ordinance has not been implemented by <br /> the County with respect to Village (now Carolina Cable) , <br />
