w W <br /> �s/ /921; <br /> SECTION XIXXV — Regulations for Development Within Critical _ <br /> Watershed Areas. - <br /> A. Intent and Purgos-e — The primary intent _of the Critical <br /> Watershed Ordinance in Durham County is to protect and <br /> enhance our water resources and insure a healthy economic <br /> environment. The purpose of the Critical Watershed District <br /> is to establish criteria to protect existing watersheds in <br /> Durham County. This Critical Watershed District is designed <br /> as an overlay district. All development •within the Critical <br /> Watershed District shall comply with the requirements of this <br /> section and with the requirements of the zoning district in <br /> which they are located. Within the range of permitted land <br /> uses which can be located- within the District, this section <br /> establishes performance standards which apply to development <br /> which occurs there. <br /> 3 . !4}m „ Q �,a»r i ctr * — The- Critical Watershed District <br /> may be established for certain lands within the watershed of <br /> any public drinking water reservoir which lies in Durham <br /> • County. The District shall consist of two parts : 1) a Water <br /> Quality Critical Area; and 2) a Water Quality Basin Area. <br /> A Water Quality Critical Area may be established for land <br /> which lies adjacent to the shoreline of the reservoir at <br /> normal pool level and extends within the watershed area of <br /> the reservoir to a point beyond either the ridge line of the <br /> reservoir watershed or one mile from the shoreline of the <br /> reservoir at normal pool level, whichever is the shorter <br /> distance. The boundaries for the Water Quality Critical <br /> Area shall be set at places of identifiable physical features <br /> 3 on Durham County Tax Maps, such as streams, easements, <br /> streets, railroads, or property lines. In a case where the <br /> one mile distance is the shortest applicable distance, and <br /> where there are no nearby identifiable features on Durham <br /> County Tax Maps to indicate the Water Quality Critical Area <br /> boundary, said boundary may set at the nearest identi- <br /> fiable feature between one (1) and two (2) miles <br /> from the shoreline at normal pool level. A property <br /> owner may at their own option and expense employ a registered <br /> land surveyor to mark on the ground by survey for recorda- <br /> __ __ __ tion either the ridge line or the one (1) mile line as the <br /> boundary of the Water Quality Critical Area. <br /> A Water Quality Basin Area may be established for the , . <br /> remaining part of the watershed area of the reservoir., <br /> ,: - y- : For porticns of the watershed draining directly to <br /> :Class A II water supply segments of the reservoirs as <br /> designated by the North Carolina Environmental <br /> .
