This problem would be resolved if a <br /> condition was attached to preliminary plan approval which <br /> would require Road "A" to stub-out to the western <br /> property line to allow access or if the Planning Board <br /> would require all streets in the development to be built <br /> as part of the Final Plat for Phase I . He indicated that <br /> an agreement had been reached between his client and the <br /> owner of San Reba Woods to this effect. Prince <br /> concurred. Brough asked the Planning Board to add such a <br /> condition to its recommendation. <br /> Jacobs informed Mr. Brough that such a condition could <br /> not be attached to this preliminary plan. The Final Plat <br /> as submitted is only for Phase I and the roads go through <br /> Phase II and III . Yuhasz also responded that such a <br /> requirement is not one that the Planning Board usually <br /> requires. <br /> Jacobs stated that if the applicant wished to present a <br /> different Final Plat which would address these concerns, <br /> that would perhaps provide a better opportunity for the <br /> compromise that the attorneys are working toward. <br /> Two conditions were added by consensus : that the roads be <br /> named on the plan and that Phase 2 line be moved to <br /> include pedestrian easement. <br /> VOTE: Unanimous. <br /> k.
